General terms and conditions

1. Purpose
The following General Terms and Conditions (“GTC”) govern the events held on the premises of Swiss Gastro Betriebs GmbH (hereinafter “Löwen”) and all catering services.

2. Prices
Our prices are in Swiss francs, including value-added tax.

3. Validity of the offer and prices
For each event, Löwen creates an offer and sends it to the customer (by mail or e-mail). The offer is valid for 10 days from the date of delivery. Upon acceptance of the offer, the customer declares compliance with and acceptance of the GTC that is in effect. Upon acceptance of the offer, the value of the services agreed on is determined provisionally, i.e., it is subject to later adjustments, such as additional consumption, additional guests, or an extension of the event (“provisional order value”).

4. Food and beverages brought to the event
Unless otherwise agreed, the customer shall obtain all food and beverages from Löwen. For food and beverages brought by the customer, a tap fee will be charged. This amounts to CHF 30 per 75cl of wine.

5. Notification of the number of guests
The customer reports the final number of participants four working days in advance and confirms it again at least 24 hours before the event. If, at the beginning of the event, fewer than the registered guests attend, the registered number of guests will still be charged. If more than the registered number of guests participate, the corresponding charges will be added.

6. Occasion endings and extension
Events can be held until 4:00 a.m. by request. For an extension after midnight, a permit must be obtained at the customer’s expense (CHF 150) at least 30 days in advance by Löwen.

7. Cancellation
In the event that an event is canceled by the customer up to 10 working days before the event, 50% of the provisional order value must be paid by the customer; it is 70% for cancellation up to 5 working days before the event, and 100% in the event of cancellation after that period.

8. Terms of payment
Invoices are payable within 10 net days from the invoice date. We also reserve the right to deliver only against credit card or advance payment. No invoices will be issued abroad; payments by guests from abroad must be made exclusively by credit card or prepayment.

9. Liability
Guests are liable for all damage caused by them to the Löwen’s property and third parties while participating in the event. No liability can be accepted for damages to or loss of guests’ property. Participation in the event is at one’s own risk and responsibility.

10. Final provisions
These GTCs can be changed at any time, but the version in effect at the time of signing the offer is always authoritative.

11. Applicable law and place of jurisdiction
Swiss substantive law shall apply exclusively. The place of jurisdiction is the ordinary courts at the registered office of Swiss Gastro Betriebs GmbH.
